St Kitts & Nevis: Couple in leaked sex tape wins court case against police

St. Kitts and Nevis (WINN): The couple whose private sex tape was released to the public by police officers has been awarded $500,000 in damages- $350,000 for the female and $150,000 for the male.

The matter was heard in December 2015 before Justice Lorraine Williams, resident judge in Nevis. The judgment was delivered Monday morning. The claimants were represented by Angelina Gracy Sookoo of the Law Offices of Sylvester Anthony while the respondents, the Attorney General and Commissioner of Police, were defended by Crown Counsel in the Attorney General’s office Violet Williams.

The judge ruled that the police officers who leaked the sex video had breached the claimants’ constitutional rights. In the video the female’s face was exposed while only the lower body of the male was visible.

The video went viral on various phone apps and social media platforms.

The couple filed a constitutional motion against the state in November 2013.

According to the claimants’ attorney, sometime between April and May 2013 the male victim, who resides in Nevis, was arrested on suspicion of robbery. While he was in custody the officers took the memory chip out of the suspect’s phone and viewed its content on an office computer. The officers came across a video of the suspect and his girlfriend engaging in sexual acts, downloaded it to their phones and disseminated it to persons in the public.

The judge condemned the actions of the police in this matter, pointing out that they are servants of the state charged with protecting the rights of individuals.
