Judge reserves decision on South Sound filling dispute

Justice Charles Quin heard both parties in the dispute over whether RC Estates have the right to remove 50 feet of recovering mangrove buffer that runs 2,000ft along the coastal lots of a proposed development in the South Sound.

After hearing both sides of the case and according to a spokesperson from the Protect South Sound committee Justice Quin has reserved his decision until some time within the next 2 weeks, by or before November 6th.

Until then the temporary injunction to cease all filling that was granted last week remains in place.

The Protect South Sound Committee and the Cayman Islands Department of Environment believe that the Central Planning Authority (CPA) made a decision which is not, as was claimed, based in law and that no costal boundary can be fixed, which means RC Estates’ efforts to reclaim a 2003 land boundary which has since been lost to the ocean is wrong.

RC Estates commenced filling in over the mangrove protected area last week despite having been served a Notice of Appeal to the CPA decision and this resulted in much protests and media coverage. However, half of the area was filled before the temporary injunction was put into place.
