CONCACAF Disciplinary Committee fines Deportivo Toluca for unauthorized video tapin
MIAMI, FL (Tuesday, April 01, 2014) – The Confederation of North, Central America and Caribbean Association Football (CONCACAF) announced today that its Disciplinary Committee has fined Deportivo Toluca FC for infringement of the CONCACAF Champions League Team Media Guidelines and consequent breach of the FIFA Disciplinary Code unsporting behavior and Fair Play.
The disciplinary actions come as a result of infractions by Deportivo Toluca, pertaining to unauthorized videotaping of the official training session of CONCACAF Champions League opponent San Jose Earthquakes before the team’s return leg of the CCL quarterfinal series in Toluca, played last Wednesday, March 19.
Following proceedings of the CONCACAF Disciplinary Committee, and examination of the evidence on file, the Disciplinary Committee rendered a $5,000 USD fine in accordance with Article 6 of the CONCACAF Champions League Regulations and the below-cited articles of the FIFA Disciplinary Code:
Deportivo Toluca FC is regarded as having breached Art. 2.2.4.1 of the Team Media Guidelines and Art. 57 of the FIFA Disciplinary Code for unsporting behavior and Fair Play in view of the unauthorized filming of a training session of San Jose Earthquakes.
Deportivo Toluca FC has been sanctioned in accordance with Art. 6.2 of the CONCACAF Champions League Regulations and Arts. 14 and 15 of the FIFA Disciplinary Code.
Deportivo Toluca FC is reprimanded for having committed the aforementioned breach and ordered to pay a fine in the amount of $5,000 USD.
A complaint filed to CONCACAF by the San Jose Earthquakes alleged that Deportivo Toluca FC filmed without authorization parts of a closed training session on March 18, 2014 at Estadio Nemesio Diez.
To inform the decision of the Disciplinary Committee, CONCACAF followed due process for such a complaint by requesting a summary report of the incident from Deportivo Toluca FC, which was received on March 26, 2014.
In accordance with art. 6.5 of the CONCACAF Champions League Regulations, the present decision is not subject to appeal.
