The CJC Final Report, AIFMD reform and reshoring AI

The Civil Justice Council (CJC) has published its final report on third-party funding of civil litigation in England and Wales. The aim of the CJC Final Report is to signal to the world that England is a place for funders to do business, through proposed measures like the rejection of caps on funders’ returns and the rejection of state-level regulation of funding in arbitration. In April this year, HM Treasury published a consultation proposing to streamline the framework for the regulation of Alternative Investment Fund Managers in the UK. The Financial Conduct Authority also published a Call for Input, setting out its approach to regulating AIFMs within the proposed framework. The aim of these proposals is to make the UK more attractive for the asset management sector, while potentially marking the first area of significant regulatory divergence between UK and EU law since Brexit.
