Volkswagen reaches $157M ‘Dieselgate’ settlement; gets approval to sell diesels again

By Ashlee Kieler From Consumerist

Making progress VOlkswagen settlement deal agreement starting the sale for sale fixing the defect defeat devices Dieselgate

Volkswagen is inching closer to putting its “Dieselgate” scandal in the rearview mirror. The automaker has agreed to a $157 million settlement that will end lawsuits in 10 states, and it has been cleared to start selling diesels in the U.S. again.

Volkswagen announced Thursday that it had reached an agreement [PDF] with the attorneys general of 10 states to resolve additional environmental and consumer claims over its use of so-called “defeat devices” to skirt federal emissions standards.

The $157 million settlement will be split between Connecticut, Delaware, Massachusetts, Maine, New York, Oregon, Pennsylvania, Rhode Island, Vermont, and Washington and used to offset the environmental impact of the excess emissions.

Each of the states in the settlement are what is referred to as “Section 177 States.” This means they have all incorporated into their state law more stringent auto emissions standards established by California under the Clean Air Act.

By reaching the agreement, VW says it “avoids further prolonged and costly litigation as Volkswagen continues to work to earn back the trust of its customers, regulators and the public.”

New York Attorney General Eric Schneiderman, who accused VW of committing fraud in a July 2106 lawsuit, says his state will receive $32.5 million as a result of the settlement.

“Volkswagen, Audi and Porsche tried to pull off an extraordinarily cynical corporate fraud – deceiving hundreds of thousands of consumers, pumping thousands of tons of harmful pollution into our air, and flouting New York and federal environmental laws designed to protect public health,” Attorney General Schneiderman said in a statement. “Now, this state environmental penalty makes clear that no company – however large or powerful – is above the law in New York.”

The agreement is in addition to VW’s previous 44-state settlement reached last year to resolve state consumer protection claims. However, the company notes that settlement did not include claims for injunctive relief or restitution related to 3.0L TDI V6 vehicles, which are included in the settlement announced today.

In other VW “Dieselgate” news, Bloomberg reports that the car maker announced that nearly two years after it stopped selling diesel-engine vehicles in the U.S. it has received approval from the Environmental Protection Agency to allow dealers to offer for sale model year 2015 vehicles with approved emission modifications.

A spokesperson for VW tells Bloomberg the company is still finalizing the details of the program.

For now, the sales will apply only to the approximately 12,000 vehicles in dealer stock. The spokesperson tells Bloomberg that eventually sales will include used 2015 diesels that have been bought back by the carmaker as part of its settlement with U.S. regulators.

VW issued a stop sale on the vehicles in Sept. 2015, just days after the company’s use of so-called “defeat devices” to skirt federal emissions standards came to light.

The emissions software update was actually approved in January when the EPA and the California Air Resources Board said VW had provided an adequate fix for 70,000 2-liter Volkswagen vehicles that release up to 40-times the allowable rate of nitrogen oxide.

The remedy, which is to take place in two phases over the next year, applied to model year 2015 Volkswagen Beetle, Beetle Convertible, Golf, Golf SportWagen, Jetta, and Passat, and the model year 2015 diesel Audi A3.

The first phase, available now, will remove the defeat device software and replace it with software that directs the emission controls to function effectively in all typical vehicle operation, the EPA says.

The second phase, which will take place next year, involves VW installing additional software updates and hardware, including a diesel particulate filter, diesel oxidation catalyst, and NOx catalyst — all of which are needed to maintain vehicle reliability and emissions performance over time.

Storm possibly forming… way north of the Caribbean

From 721News

Storm possibly forming…

An area of disturbance way north of the Caribbean (northeast of the Bahamas) was showing signs of developing during the last few days. The NHC (National Hurricane Center) gave this system a 20-30% chance to develop within the next 5 days; however certain conditions may NOT allow further development to take place.

If it does develop (against all odds) into a tropical (or sub-tropical) storm, it will be named Arlene. This system, however, will NOT affect the SSS Islands or the rest of the Caribbean.

US: No LGBTQ category included in census proposal for 2020 count

From Newsmax

The U.S. Census Bureau did not include a separate count of LGBTQ Americans in its proposal for the 2020 Census.

The category had been sought by gay rights advocates.

The bureau counts Americans according to race, gender and other characteristics. Its proposal submitted to Congress this week did not have a separate category for LGBTQ.

A Census Bureau spokesman told The Washington Times that they had been asked by members of Congress to include the questions, and had been studying it — but determined there was no “federal need” for that information to be collected.

But gay rights advocates say it’s more evidence that President Donald Trump is going back on a campaign promise to protect the gay community. Last week, the Department of Health and Human Services removed questions on sexuality from two of its surveys.

The Trump administration also has canceled an Obama administration directive that students should use the bathroom that matches their gender identity.

Guernsey firm starts on Cayman Islands tyre mountain

From Guernsey Press

GUERNSEY Recycling Group has finally started shredding a mountain of more than half a million tyres in the Cayman Islands.

image: http://guernseypress.com/wpmvc/wp/wp-content/uploads/2017/03/ttryr.jpg

Cayman-based contractor Island Recycling, an associate company of the Guernsey business, has a $1.25m. contract which it won last year to clear the tyres in a landfill site, known to locals as Mount Trashmore.

Guernsey Recycling has been involved in establishing a one-acre facility at the landfill site, where it has installed machinery imported from the US to process whole tyres into two-inch rubber chips at a rate of one every four or five seconds.

Work started last week, with the site opened by Cayman premier Alden McLaughlin.

A Cayman developer is already taking daily deliveries of tyre-derived aggregate, which will be used in non-load bearing construction, landscaping, drainage works and as a road base.

It is believed that there are at least 500,000 tyres which have accumulated at the dump over the last decade or more, but no one has ever counted them.

About the National Gallery of the Cayman Islands

Established in 1996, the National Gallery of the Cayman Islands (NGCI) is the country’s leading visual arts museum and education centre, charged with promoting and encouraging the appreciation and practice of the visual arts in the Cayman Islands. This mission is achieved through exhibitions, education/outreach programmes, school tours, community festivals, and ongoing research projects. Holding up to six exhibitions annually at our central exhibition space, and satellite venues around Grand Cayman and the Sister Islands, the curatorial team strives to create a balance between exhibitions of quality Caymanian artwork with art from further afield. This is achieved by working with a broad cross-section of artists and ranging from site-specific work to more traditional gallery-based projects.

NGCI is at the forefront of visual arts education in the Cayman Islands hosting 25+ education and outreach programmes monthly, across all three islands. These programmes aim to capture every age group in our community from the youngest pre-schoolers to senior citizens, in addition to marginalized members of our community. They combine arts education with enriching creative experiences which foster creativity, help build self-esteem, and provide effective and invaluable explorations of culture, cultural heritage, national identity and community values.

NGCI Site & Facility

The new National Gallery building is a 9,000 sq. ft. facility situated on the western side of the Esterley Tibbetts Bypass, close to Camana Bay town centre and adjacent to the Harquail Theatre. The new development is home to two temporary exhibition areas, an art studio, library, auditorium, sculpture garden, Art Café and Gift Shop, and a permanent gallery for the Cayman Islands National Art Collection.

As part of the National Gallery’s long-term business plan, an auditorium and multi-purpose event space have been incorporated into the design providing flexible venue options for conferences.
